Are there penalties for workers’ compensation fraud?

Yes, an individual fraudulently claiming workers’ compensation benefits is subject to criminal prosecution. Likewise, an employer obtaining workers’ compensation insurance by fraudulently under-reporting payroll or engaging in other material misrepresentations is subject to criminal prosecution. This is serious. The best way to protect your claim is by being truthful about the incident and your medical history.

A good example of a fraudulent injury claim: In 2017, an individual was in a car accident, then stated it left her unable to work for over five years, specifying she could no longer lift heavy objects. But in 2018, a photo of her participating in a "Christmas-tree-throwing competition" surfaced. This along with other notable evidence of her capability of physical activity was enough for the court to rescind her injury claim.
